论司法的社会效果

"坚持法律效果与社会效果的统一"逐渐成为法院系统检验审判工作的标尺。但是,由于对于"社会效果"没有正确的认识,法院一般以民众满意度和社会认同作为判决应该考虑的社会效果。法律是一种预测机制,能够给人们提供行为的激励,而社会效果在本质上也是对人们未来行为提供一种预测。法律效果与社会效果在本质上是一致的,因此,法律效果与社会效果是统一的。

On The Social Effect of judicature

Keeping the unification of law effect and social effect becomes the criterion of the court s judgment.Because of lacking proper sense,the courts recognize the satisfaction of people and the identity of society as the social effect of judicature.As a mechanism of prediction,which law supplies incentives to the human,while the social effect also offers a prediction to the people in nature.In essence the law effect is in accordance with the social effect,so they are integrated.
