“省管县”体制改革中的法律冲突研究

在宪法层面,＂省管县＂体制改革虽然具有合宪性基础,但其在各层级行政机关行政权限配置上缺乏明确规定,产生了一定的法律冲突,即：在法律上,立法的缺失、法律规范的缺位、政策先行的困境等给＂省管县＂体制改革带来的法律冲突。为此,制定或修改法律以及选择性执法将成为＂省管县＂体制改革法律冲突解决路径在不同情境和不同阶段的理想选择。
