| 摘 要： | 证明责任分配是证据法中的核心内容,又是决定诉讼结果的关键性因素。本文结合证明责任分配的理论,对我国证明责任分配的法律规定,尤其是证明责任分配的司法自由裁量问题进行了论述,并提出了相关的完善建议。
