非常夫妻财产制之缺位与确立

夫妻财产制是婚姻家庭制度的重要组成部分,我国现行婚姻法夫妻财产制度是基于夫妻关系正常状态下的一种立法设计,在一定程度上忽视了婚姻关系中各种非常态情况存在的现实。因而有必要设立非常夫妻财产制以弥补现行夫妻财产制度之不足,从而促进婚姻家庭领域法律公正价值的实现,并有效保护第三人经济利益,维护交易安全。

Couple's property system is a major component of marriage and family system. In China's current marriage law, couples' property system is a legislative design based on the relationship between husband and wife under the normal state, to some extent ignored abnormal state of reality in the various marital relationships. It is necessary to establish an abnormal couples' property system to cover the inadequate existing marital property system,thereby to promote the realization of legal fair value in the field of marriage and family,to effectively protect the economic interests of a third person,and to safeguard the security of transactions.
