摘    要:符号学是专门研究符号及其意指活动之规律的科学,本质上属于跨学科的方法论。由于商标本身就是一种符号,商标法既是市场经济社会的重要法律,又是一种符号规范,因此,在商标法学领域,符号学不仅是一种研究方法,而且还具有本体上的意义。透过商标法基本范畴的符号学分析,我们可以对商标、商标权和商标侵权的本质做出直观而合理的解释,从而准确把握商标制度的运行机理。

Abstract:Semiotics is a study that focuses on signs and rules of signification,the essence of which is a methodology across the whole field of social sciences. Because the object itself of trademark law is a kind of sign,the trademark law is an important field of law in a society of market economy as well as a kind of semiotic rule. Therefore,in the area of the trademark research,semiotics is not only a kind of methodology,but also relates to ontological issues. Through the semiotic analysis of the basic categories of trademark law,we could grasp the essence of trademark,trademark right and trademark infringement directly and reasonably,mastering the operation of trademark system precisely.
