翦论被告人翻供情形下对口供的审查

司法实践中，犯罪嫌疑人、被告人推翻原有口供的现象一直存在，且占有一定的比例，处理起来也较为棘手。翻供是典型的供述不一致现象，其原因归纳起来主要有两个方面：一是被告人自身的主观原因；二是各种客观因素的影响。对口供的审查．除审查合法性、客观性、关联性外，还必须审查其应有的补强证据，否则不能单独定案。对待翻供和原供的正确态度，应该是允许翻供，同时认真审查翻供和原供的真伪，对二者既不轻视．也不轻信。因此，通过对口供特点的分析和翻供原因的总结，能够正确解决翻供情形下的口供审查认证问题．

On Investigating the Confession in the Case of Defendants' Withdrawing Confession

In judicial practice, it often occurs that criminal suspects and defendants withdraw the original confession, which is relatively difficult to deal with. The reason lies in the following two aspects： one is the defendants＇ subjective reason, the other is various objective influence. To investigate the confession, we must pay attention to effective evidences besides its validity, objectivity and relevance. We must have a correct attitude to with- drawing a confession, which should be permitted and could not readily believe it.
