| 摘 要： | 依据著作权法律、法规的相关规定,高校学报著作权的权利内容具有双重结构,即汇编作品著作权和版式设计权的有机结合。学报著作权的权利内容不同,其权利归属也不同。由于高校学报的特殊管理体制,学报整体性汇编作品著作权归于其主办高校;作为事实汇编人,学报编辑部编辑责任人员依法分享学报汇编作品的署名权;而学报的版式设计归于具有出版者资格的学报编辑部。高校学报的管理体制有待理顺,相关的立法有待完善。

| Abstract: | Literature survey shows no satisfactory answer has been given to the interest field of copyright of university journal. The paper gives an outlined analysis into current Chinese laws and regulations about copyright, and concludes that the said interest field can be defined as two integrated layers: copyright of compilation and neighboring copyright of format design. In the paper, subject of copyright of university journal is discussed relatively. |
