立法的民主化及法律监督

我国目前的立法及其实施过程中存在过多体现中央和上级意志、民众参与立法不足、公开程度不够、成本过高等问题。立法民主化要求改善执政党对立法的领导方式,树立并强化立法民主化的观念,引进和完善民众参与立法的程序制度,完善立法公开制度,提高立法效率。在强化立法事后监督上建议设立立法监督委员会,将部分抽象行政行为纳入司法审查。

On the Democratization of Legislation and Legal Supervision

Overfull central and superior will intervenes in China's current legislative process and law implementation,and many other problems such as insufficiency of public participation in legislation,inadequateness of publicity and high cost exist as well. To satisfy the demand of democratization of legislation,leading method of the Party should be perfected,the notion of democra- tization of legislation should be established and enhanced,the procedure of public participating in legislation should be introduced and completed,the publicity mechanism should be improved and legislative efficiency should be increased.A legislative supervi- sion committee may be instituted to exert post-control and part of abstract administrative acts should be the object of judicial re- view.
