宪法架构下的地方政府

主流的行政主体理论认为,地方政府是我国行政主体的重要组成部分之一。然而,从宪法的角度上分析,无论是从处理中央与地方关系的宪法原则,还是宪法确立的地方政府与中央政府的关系与领导体制、地方政府的事务管理权,乃至于地方政府的组织机构设置、公务员管理,还是从其所归属的地方国家权力机关的宪法地位,与其说地方政府属于一级独立行政主体,不如说它更多地是作为中央政府的执行体而存在的。
