建设工程领域拖欠农民工工资责任主体分析

近年来拖欠农民工工资问题愈演愈烈,不仅使农民工辛苦的血汗钱化为泡影,生活得不到保障,而且严重扰乱建筑市场的秩序,严重违反了公平原则,社会影响恶劣,亟需解决。但在我国现行的法制体系下,农民工只能向与其有直接劳动关系的单位或组织主张支付工资的请求,而不能向与其有间接联系的发包方、工程总承包方主张支付工资请求权,不利于保护农民工的利益。这一切源自于合同相对性的限制,合同相对性就表现在主体的相对性、内容的相对性以及最重要的是责任的相对性,但是我国不乏有突破这一原则的立法例。将这些突破归结到一点,可以发现突破点就在于满足实现社会实质正义的需要,将法律的天平倾向于保护社会弱势群体,以形式上的不平等实现实质的正义,将拖欠农民工工资的责任落实到实处,将发包方和工程总承包方纳入到责任体系,以切实解决我国这一关乎民生的问题。

Analysis of subject of Resposibility for Defaulting Migrant Worker's Salary in the Construction Industry

The problem of defaulting migrant workers＇ salary has been more and more serious in recent years,which not only leads to migrant workers＇ failing to get their hard-earned salary,but also disturbs the order of construction market,as well as the principle of justice,and in result it has affected the society badly and harmfully,and needs to be solved immediately.However,under the recent legal system,the migrant worker could only ask the organizations related with them directly for their salary,not other units,harming the legal rights of the migrant worker.All of this resulted from the limit of the relativity principle of the contract,which includes the relativity of subject,contents and responsibility.Of course,there is a lot of breakthrough in China legal system,which the point of them is the society essence justice.The most important thing is to lean the scales of law to the vulnerable groups,so that realize the essence justice instead of procedural justice and carry out the real responsibility of unpaid wages,with the arm of that contractors and the contractors can be responsible for the migrant workers＇ salary,then can solve this problem related with livelihood.
