| 摘 要： | 观念的力量大于法律规则和技术，观念的滞后制约法律规则和技术作用的发挥，同样，观念的解放必然带来规则和技术的进步。反腐败刑事司法的实质性进步，最终取决于法治观念的进步程度。唯有以先进而正确的观念为指引，刑事司法规范和技术才能发挥应有的作用。

| Abstract: | Coordination of China＇ s domestic criminal law and the UNCAC is an issue of focused attention among today＇ s legal profession in China. Taking the crime of bribery as an example, and looking from a comparative angle of view, this paper provides an analysis of the inter-relationship of minds and techniques in the field of anti-corruption justice in China. The author holds the opinion that the strength of minds of man is stronger than that of legal rules and techniques. Lagging minds will only limit the function of legal rules and techniques;however, the liberation of minds will result in progress of legal rules and techniques. Therefore, the substantive progress of anti-corruption justice in China is ultimately dependent on how far China＇ s mind could go. Only advanced minds could lead the legal techniques to develop and function duly. |
