| 摘 要： | 法律推理的科学模式应是形式论证与实质论证的有机统一.实质论证解决法律推理大小前提的真实性、合理性问题,它是法律推理的外部证明过程;形式论证解决前提之间以及前提与结论之间的逻辑联系,它是法律推理的内部证明过程.只有这样才能使法律的形式合理性(形式正义)与实质合理性(实质正义)在法律推理中得到和谐的统一.

| Abstract: | This paper holds that the scientific mode of legal deduction should be the organic unification of formal reasoning and substantial reasoning .As the external process of legal deduction, substantial reasoning solves the problem of the authenticity, rationality, and validity of the major premise and minor premise of legal deduction. Formal reasoning, which is the internal reasoning process of legal deduction, solves the problem of the logic ralationship between premises and conclusion. Only through these process can the harmonious unification of formal rationality and substantial rationality of law be achieved in legal deduction. |
