| 摘 要： | 理论界和实务界对于实施律师费转付制有不同的观点.本文从法理基础、法律依据、判例基础、国际通例等四个方面论述了应当实施律师费转付制的理由,探讨了律师费转付制的预防和鼓励功能,阐述了该制度的适用范围和适用条件及保障条件,并对该制度的实施提出了建议.
