论生态法域与传统法域的价值冲突

一般认为,法域是根据法调整的社会关系的不同来划分的,但实际上不同的法得以整合成一个法域,更深层次的原因在于它们人性假设的相同。作为一个新兴的第四法域,生态法域上的人是“大我”、利他和有限理性的生态人,这就决定了生态法的价值取向与其他法域必然有所不同。生态法域侧重生态安全、种际平等以及各物种在地球上生存繁衍的自由。在处理生态法域与其他法域价值冲突时,必须遵循追求人与自然共同利益的原则。
