| 摘 要： | 在夫妻财产关系上，我国《物权法》与《婚姻法》存在着诸多法律适用上的冲突，就物权的转移、变动而言，《物权法》的相关规定是一般规定，而《婚姻法》对夫妻婚前财产、夫妻共有财产的规定是特别规定。因此，在法律的适用上有必要研究《物权法》作为基础性法律的用益物权制度对夫妻婚前财产发生变化和婚后共同财产发生纠纷的实践处理和法律适用。

| Abstract: | In the relationship concerning marital property,there are conflicts in the application of Real Right Law and Marriage Law in China.On the alienation or alteration of real right,the rules of Real Right Law belongs to common regulations,while the rules of Marriage Law belongs to special regulations;but in application,special law surpasses the common law.Real Right Law is a basic law.It is necessary to study usufruct system of the Real Right Law to solve the premarital and postnuptial property disputes. |
