论和谐司法的时代内涵

和谐司法是一项针对现行司法法治主义的改革策略,和谐司法也是一种实现司法法治主义的转换机制.和谐司法产生的时代背景赋予了和谐司法自身特殊的时代使命:发掘适合中国国情的社会纠纷排解新模式,调剂现行司法法治主义之不足,开拓有中国特色的司法法治主义新境界.我们要防止对和谐司法的错误理解,和谐司法不是单纯的政治口号,和谐司法也不等于德治、人治.正确地理解和谐司法的时代内涵,在司法工作中就必须一方面坚持司法法治的基本理念不动摇,另一方面又要保有开放的司法法治思想.

On Harmony Judicial Connotation of the Times

Harmony justice is a reform strategy for the current judicial doctrine of the rule of law,the harmony justice is also a realization mechanism of judicial Legalism conversion.The era background of harmonious justice gives harmonious justice special era mission： to explore the new social disputes resolving mode which is suitable for China＇s national conditions,swap the deficiencies of the existing judicial doctrine of the rule of law,and open up new realm of the judicial rule of law with Chinese characteristics.We would prevent misinterpretation of the harmonious justice,which is not a mere political slogan,and is not equal virtue or the rule of man.To understand correctly the connotation of harmony justice,the basic concept of the rule of law must be adhere to unswervingly on the one hand,and an open judicial thought of the rule of law must be maintained in another hand.
