| 摘 要： | 人身权是公民重要的宪法权利,刑事程序对公民人身自由的限制和剥夺应合理且正当。合理的刑事程序理应反映人们对刑事诉讼的价值诉求。我国刑事诉讼法的价值选择是秩序、效率兼顾自由、公正。刑拘、逮捕的程序设计存在缺陷,未能反映这一价值选择,应作如下修改:减少拘留审查时间,降低逮捕证明要求,建立逮捕司法审查制度。

| Abstract: | Civil right is an important constitutional right for a citizen,so the limitation and deprivation of citizen's human freedom by criminal procedure should be reasonable and proper,which should reflect people's pursuits for value of criminal proceedings.The selection value of criminal proceedings in our country is being orderly,effective,free and impartial.There are defects in the procedural establishment of criminal detention and arrestment so that the value selection can not be reflected,therefore,some revisions should be made as the following: to reduce the time for detention and investigation,to lower the requirements for arrestment verification and to establish judicial investigation system for arrestment. |
