| 摘 要： | 我国产品责任没有单独立法,其内容主要规定在公、私法合一的《产品质量法》等法律中。这种立法模式不利于彰显产品责任法的重要作用。我国应借鉴欧美发达国家产品责任法立法模式,制定单独的产品责任法,或者将产品责任在侵权法,或者在民法典侵权法部分予以规定。

| Abstract: | China has no pure law on products liability, whose content hides in the Law of Products Quality Acts, which is made up of public and private law. This state will not show the importance of the law for product liability. China should take the western countries practice in the field as example, and make the independent law, either make the regulation in the law of torts, or appear in the torts section of the civil law. |
