| 摘 要： | 2009年12月公布的《国有土地上房屋征收与补偿条件（征求意见稿）》属于国务院制定的行政法规。其适用范围应当同时符合几个条件：（1）为了公共利益的需要；（2）国有土地上房屋；（3）对房屋所有权人。确定补偿标准非常重要，应在具体细节上给予严格的界定。

| Abstract: | The ＂（ Draft for Seeking Suggestions） of Expropriation and Compensation Statute for Properties on State- Owned Land＂ is one of the administrative regulations legislated by the State Council. Its application scope should simultaneously meet the following conditions ： 1 ） for the requirement of public interests ; 2 ） properties built on state owned land;3 ）for property owners of house. The determination of compensation standard is very important and should be defined rigorously on details. |
