| 摘 要： | 清朝末年,沈家本奉命主持刑律修订,制定出中国第一部近代刑法典——《大清新刑律》。该律的问世,既标志着中国刑法近代化的开始,也是沈家本修订刑律取得一定成功的明证。沈家本修订刑律成功首先取决于历史条件,其次得益于他的个人素质。
