脱离物的善意取得

Good-faith acquisition can not be applied to detached property,which is a basic system in most modern civil laws worldwide.Though China's property law has acknowledged the system,it does not provide for good-faith acquisition of stolen property.It is on both individual and overall interests,game theory and the analysis of economic cost,analysis of realistic methodology of jurisprudence as well as on the research of good-faith acquisition systems of detached property in most continental law system countries that good-faith acquisition is founded.Establishing good-faith acquisition system of deviated property in China can not be separated from the liquidation of existing laws with a blend of public and private laws,aiming to realize the value of the system as soon as possible.
