| 摘 要： | 推定作案条件是破案的关键一步。从逻辑的角度看,作案条件即作案人的必要条件;推定作案条件的推理形式是充分条件假言推理的肯定式;排除作案人的推理形式是充分条件假言推理的否定式;确定作案人的推理形式是充分必要条件假言推理的肯定前件式。在推定作案条件的过程中,我们应避免犯三种逻辑错误。

| Abstract: | Inferring conditions of committing crimes is the first step in solving criminal case.From logical angle,conditions of committing crimes are necessary conditions of the person who commits crimes;the reasoning forms of inferring conditions of committing crimes are affirmative forms of full conditional supposing reasoning;the reasoning forms of eliminating the person committing crimes are negative forms of full conditional supposing reasoning;the reasoning forms of determining the person committing crimes are negative forms of full and necessary conditional supposing reasoning.In inferring conditions of committing crimes,we should avoid making the three logical mistakes. |
