With the rapid development of the internet technology, e-commerce has already been launched very actively in the developed countries and at home. And e-commerce contract is used extensively by people as important foundation and tool that e-commerce works, the great one has promoted the development of digital economy. The first "e-signature law " of our country will be implemented formally on April 1, 2005, to the electronic safe problem of trade that e-commerce involves, the court has a legal basis determining and finding. This article attempted to approach some legal questions concerning the characteristic of e-commerce contract and its concluding and exercising.
