| 摘 要： | 商法基本原则的确立，在宏观上要坚持主观标准与客观标准的统一，在微观上应反映商事关系的本质特征，体现商法的基本内容，统辖商法的具体制度，适应商法的国际化趋势。借鉴商法学者的有关研究成果，笔者将商法的基本原则界定为四项，即强化商事主体；维护交易公平；保障交易安全；提高交易效率。
