| 摘 要： | 罪刑相适应是如何形成的,尚未有人探究.罪刑相适应的形成事关对罪刑相适应原则的理解和运用,故对之探究有着极为重要的理论意义与实践意义.罪刑相适应的形成探究始于犯罪和刑罚这对刑法基本范畴内在组成的考察,牵扯出犯罪和刑罚这对刑法基本范畴的内在组成的整合问题,最终引申出罪刑相适应的内在组成.在罪刑相适应的形成探究中,犯罪的本质和刑罚的目的等将有新的展示.
