在中国法制现代化的进程中 ,中华民族的本源文化永远是其不可或缺并起决定作用的内源力 ,因此 ,如何看待自己的传统法律文化 ,如何将传统法律文化与现代法律文化实现科学合理的承接 ,从而创造出具有中国特色的现代型法制 ,是时代赋予我们的重大课题 ,本文试从传统法律文化的现代价值的角度 ,找寻传统法律文化中对中国法治化的积极的合理的因素 ,并就此谈一点看法

Reflections on Modern Value of Chinese Traditional Law Culture

In the course of modernizing Chinese legal system, the original culture of the Chinese nation is always the indispensable and decisive inner source of energy. Therefore, We've got such a major issue of modern times, i.e. How we should treat our traditional law culture; How we can make the modern law culture scientifically and reasonably continue from the traditional law culture so that we may be able to build a modern legal system with Chinese characteristics. In this essay, in view of the modern value of the traditional law culture, the author tries to find something in the traditional law culture, which may be positive and reasonable factors for modernizing Chinese legal system, with an attempt to help develop the system.
