非暴力公然获取他人财物行为的认定

非暴力公然获取他人财物行为,是指行为人未使用暴力,在被害人知晓的情况下非法公然占有公私财物的行为。修正解释引入德日刑法有关盗窃的理论,将盗窃行为扩大至公然平和的行为方式。然而,从我国已有的法律传统出发,结合我国现有的财产犯罪立法例,及目前普通民众的朴素认识和司法实务的现状,将盗窃行为扩大至公然、非秘密的行为方式还不成熟。未对财物所有人和保管人采用人身强制,但是以为财物所有人和保管人知晓的方式非法占有他人财物的行为应当认定为抢夺。
