| 摘 要： | 消费社会传统的产品责任体系无法满足现实的社会需要,产品处置阶段责任主体的空缺,导致了"公地的悲剧"。延伸产品责任扩展了传统的产品责任的责任主体体系,较好地解决了产品废弃物在处置阶段存在的问题。本文从延伸产品责任的产生和发展出发,探讨了延伸产品责任的理论基础和现实依据,并简单分析了延伸产品责任制度的责任体系。

| Abstract: | In the expends social stage, the traditional product liability system is unable to satisfy the reality the social need, vacancy of the responsibility main body in the product handling stage, has caused ＂the male place tragedy. The extended product liability expand the traditional product liability responsibility main body system, has solved the product reject well in the handling stage existence question. From extended product liability production and the development embarks, the article discusses the rational and reality basis of extended product liability, and simply analyzes the responsibility system of extended product liability. |
