摘    要:通过劳动力派遣形成的法律关系是一种复合的架构,其中包括:派遣单位与用工单位之间形成的一般的商事合同关系,劳动者与派遣单位、用工单位双方之间形成的特殊劳动关系,并以后者为核心。在特殊劳动关系中,应该区分不同的方面,在派遣单位与用工单位之间合理地划分劳动基准法中所规定的一般雇主责任。《劳动合同法(草案)》中“劳动力派遣”的相关条文有待进一步完善。

Abstract:Legal relations formed in the labor dispatching is a compound structure,which concludes: a normal business contract relation between dispatching company and using company;a special labor relation between employee and employer,which concludes dispatching company and using company.The latter is the core in the compound structure.In the special labor relation,normal responsibilities regulated in the labor law should be allocated reasonably between dispatching company and using company on different aspects.The related articles in the Law of Labor Contract(draft) need to make further improvements.
