| 摘 要： | 全球化是当代世界的发展潮流与客观趋势。全球化的发展趋势正潜移默化地影响着法理念的变迁，它深刻地改变着法的存在方式、价值取向和发展方向。传统的以民族国家为时空背景的法学理论研究必须站在以全球化为时空背景的新的视角进行研究。
