使用人责任的理论问题

使用人责任应采纳无过错责任原则，是一种替代责任或“为他人行为负责”之责任。使用人未能合理地选任、监督或培训被使用人，而就被使用人的侵权行为承担赔偿责任的，不属于替代责任的范畴，而是属于自己责任、过错责任。使用人能够证明自己在选任、教育和管理方面没有过失的，在向受害人承担赔偿责任后，可以向因故意或重大过失造成损害的被使用人追偿。
