| 摘 要： | 基因犯罪是指利用基因技术所实施的犯罪或者与基因技术滥用有关的其他一些犯罪的总称.不少国家的立法已经针对这类犯罪采取了相应的对策.防范基因犯罪的发生应当成为刑法的一项重要使命,我国刑法应对及防范基因犯罪的具体措施,一是增设"基因犯罪"这一类罪名;二是对于某些与基因技术滥用有关但却无需通过增设新罪名加以应对和防范的犯罪行为,可以直接依照现行刑法规定的某些具体犯罪加以定罪处刑.
