试析少数民族被追诉人权利保障的问题与对策——以465份调查问卷为分析样本

文章以465份调查问卷为分析样本,针对调查问卷发现少数民族被追诉人权利保障中存在立法规定不明、司法解释欠缺、不能充分使用本民族语言参与诉讼、民汉双语翻译人员缺乏、刑事法律援助不足、民族风俗习惯被侵犯等诸多问题进行分析。在梳理总结司法实践问题的基础上,尝试提出诸如完善立法、出台更具可操作性的司法解释、着力培养民汉双语司法人员及律师队伍、加大对民族地区的法律援助等对策建议,以期对加强少数民族被追诉人权利保障提供思路。

On the Problems and Countermeasures of Protecting the Rights of Defendants of Ethnic Minorities: Analysis Sample of 465 Questionnaires

This article uses 465 questionnaires as a starting point.There are many judicial interpretations of the minority's defendants'rights that do not fully use their own language to participate in litigation,the rights to obtain translations and lack of criminal legal aid,violation of national customs and habits.On the basis of combing and summarizing the judicial practice problems,this paper attempts to put forward countermeasures and suggestions,such as improving legislation,introducing more operable judicial interpretation,focusing on training judicial personnel and lawyers in both Chinese and civil languages,and increasing legal aid to ethnic areas,with a view to providing suggestions for strengthening the protection of the rights of minority prosecuted people.
