| 摘 要： | 刑事诉讼构造与刑事诉讼模式是两个既有联系又有区别的不同概念，但我国学者从20世纪80年代引用、借鉴这两种理论的过程中，没有加以区分，使我国的研究较为混乱。刑事诉讼构造是从微观研究某一刑事诉讼模式内在要素的组合，从系统到要素来研究刑事诉讼的内在功能。刑事诉讼的主体构造关系是刑事诉讼模式的构成要素，刑事诉讼构造是刑事诉讼模式的下位概念。

| Abstract: | The criminal litigation structure and criminal litigation mode are two concepts both connective and distinctive. However, Chinese scholars have not distinguished them in studying them since 1980s,which makes our country＇s research of them rather chaotic. The criminal litigation structure studies the combination of intrinsic elements of certain criminal litigation mode microscopically, studying the internal functions of criminal procedure from system to elements. The subject structure relation of criminal litigation is the components of criminal litigation mode, and criminal litigation structure is the lower position concept of criminal litigation mode. |
