危险驾驶行为的刑法规制

现阶段,以危险方式驾驶机动车辆而导致交通事故的现象有增无减,这给人们的生命、健康安全造成极大威胁。德国、日本、英国等国家的刑法规范对危险驾驶行为进行独立的刑法评价,成立危险驾驶罪。我国刑法对因危险驾驶行为而导致交通事故的规定依附于交通肇事罪和以危险方法危害公共安全罪两个罪名。然而,危险驾驶行为有自己独立的罪质,我国刑法应借鉴其他国家的做法,增设危险驾驶罪。
