古代中国判例传统:成因及启示——案例指导制度的另一观察视角

中国古代有着悠久的判例传统,其成因有经验哲学、贵族精神以及实用性。中国古代判例传统对我国当今案例指导制度建设的启示有二:一是确立成文法为主判例为辅的二元法源形式;二是加强对法官自由裁量权的规制,具体包括加强法官裁判过程的程序控制和提高法官的人文素养。

The Tradition of Case Law in Ancient China: Cause and Revelation——Case guide system study from another perspective

There are centuries-old tradition of case law in China,with experientialism,aristocrat inspirit and pragmatism being its cause.Statute system of continental law system is introduced into China blindly,as a result of double-lose of law and morality.To solve this difficult problem,we should bring form of law and culture tradition and philosophy of our times unified and introduce into case law;besides,we should enforce more control on judicial procedure.
