| 摘 要： | 刑事证明标准通过判断事实真伪、平衡诉讼结构和量化证明责任为被追诉人的实体性人权与程序性人权提供保障。我国刑事证明标准的规范功能未能正常发挥，由此导致了人权保障功能的缺失。应当积极推动立法的科学化，健全司法保障机制，并弘扬人权意识和法治观念，以促进刑事证明标准人权保障功能的实现。

| Abstract: | Criminal standards of proof provide defendants with the protection of substantive human rights and procedural human rights by judging the truth,balancing the structure of action and quantifying the burden of proof.But in China,the institutional functions fail to perform properly with the result that the function of human rights protection doesn't realize successfully.We should make the law more reasonable,perfect the mechanism of administering justice,and develop consciousness of human rights and conception of rule of law,so as to accelerate the realization of the function of human rights protection. |
