20世纪以前,国际法以强制执行为主要实施方式。因缺乏强制执行手段,国际法的法律属性因而受到广泛质疑。20世纪后半期以来,国际法在规范结构和实施机制上有了较大发展。在某些领域,国际法规范开始由消极性规定转向积极性规定,而国际法的实施机制也由传统的自愿遵守和强制执行转向报告监督、帮助激励等遵守机制建设上。国际立法正在经历由权利体系的立法到救济管理的立法转变的过程。

The Future of International Law：to Enforce Compliance with Management

Before 20th century,enforcement is the main method of implementing international law.Due to the lack of powerful means,international law has been disputed of its legal character.From late 20th century,international law has evolved greatly in norms structure and mechanism of implementation.In some area,negative norms turns to positive ones,mechanism of implementation thus go from enforcement to compliance mechanism.International law has undergone the process of right legislation to remedy legislation.
