| Abstract: | Aiming at providing theoretical guidance to the drafting of Chinese Shipping Law,based upon legal theory and the basic theory of economic law,combing the characteristics of shipping economy and shipping market,this paper analyses the basic theoretical issues in the drafting of Chinese Shipping Law including the subject-matters to be regulated,the definition and the status of Chinese Shipping Law,its relations with other laws,the guiding ideology in the legislation,the purposes of legislation,the basic principles of legislation,and the rules to be established. |
