外部性视野下我国价格听证制度的完善

由于《价格法》和《政府制定价格听证办法》对价格听证的规定比较粗略，消费者的知情权、参与权、表达权、救济权等得不到真正实现，政府、企业的程序义务、违反义务等得不到真正落实，导致在政府、企业、消费者的利益三角中消费者处于弱势地位，使得消费者权益受到侵害，从而遭受负外部性。价格听证中的外部性的经济法克服需要：其一，赋予消费者相应的权利并保证其实现；其二，赋予经营者相应义务并保证其实现；其三，赋予政府相应职责并保证其实现。

Perfection of System of Price Hearing in Our Country in Perspective of Externality

Because the price hearing provisions in the Price Law and the Price Hearing Method Established by Government are sketchy,consumers’ right to know,to participate in,to express,and the right to get relief were hard to true realized,the duty of program obligation and violation of the government and the enterprise were not really implement,the consumer were at a disadvantage in the government,enterprises,the interests of the consumer triangle,which makes consumer’s rights and interests are infringed upon,and suffer negative externalities.The Economic Law to overcome the externality of hearing prices need to do something,such as,First,give consumers the corresponding rights and ensure its implementation;Second,give operators corresponding obligations and to ensure its implementation;Third,give the government the corresponding responsibilities and ensure its implementation.
