| 摘 要： | 作为量刑制度中的重要环节，自首与立功制度在我国的刑事司法中对于更好的实现宽严相济的刑事政策具有重要作用。在司法实践中，却出现了很多与刑事立法的本意相冲突的地方，拟就自首与立功制度存在的问题进行完善提出自己的看法。
