| 摘 要： | 习惯法对法治的可能贡献取决于其自身所具有的认同性、变迁性、中介性等特征,在这个意义上,生态习惯法最有可能对西部社会法治给与贡献,因为出于生存关照,生态在西部民族地区表现为一种“生活的样态”,民众将生命、精神与自然生态相统一,并与民族宗教精神的高度契合,使得生态习惯法具有了普适性与效力保障,这既构成了生态习惯法对西部社会法治的可能贡献的理由,又对西部社会的法律信仰、法美学构建具有进一步的意义。

| Abstract: | Customary law's possible contribution lies on the characteristics of aprroval, variance and medi-nature, it is most possible that zoological customary law can offer contribution to West China's rule of law in a since. Because zoology is the basis of subsistance of West nationality region, people take life, spirit and zoology as a whole, zoological customary law is adapted universally and its effectiveness is guaranteed. Therefore, it has profound significance for legal belief and law aesthetics construction. |
