| 摘 要： | 根据我国现有法律规定,定罪与量刑适用于同一证明标准,而国外的做法又有所不同,多为多元化的证明标准。应在我国建立以法定量刑情节与酌定量刑情节为主要划分依据的多元化量刑证明标准。

| Abstract: | According to the existing law in China, the conviction and sentencing is applicable to the same proof standard while it usually adopts multi - proof standards abroad. This paper advocates establishing legal sentencing plot and discretionary sentencing plot as the basis of diversified sentencing standards in China. |
