| 摘 要： | "正谲折狱",作为一种取证文化,在古代有其突出的特点。"正谲折狱",它是获取当事人有关案件事实的陈述,特别是获取被告人口供的一种方法。它包括"正"术和"谲"术两个不同层面。郑克认为"鞫情之术,有正,有谲。正以核之,谲以擿之。术苟精焉,情必得矣。"作为一种与刑讯法相对的取证方式,这种相对平和的诉讼模式背后其实反映的是"限制刑讯"以及"狱无淹滞"的诉讼理想,这和古代社会"罪从供定"的司法传统有着紧密的联系。

| Abstract: | The times. The judge uses trial method of ＂ this trial method Zheng Jue＂, as an evidence culture, has its outstanding features in ancient to obtain the relevant statement about the case facts, especially the defendant＇s confession. It includes the method of Zheng＂ and the method of ＂ Jue＂ Zheng Ke thought that these two methods used in conjunction with each other can help the judge to settle the case. The trial method ＂ Zheng Jue is different from in torture＂ and ＂ to quisition improve by torture. This litigation mode actually reflects the Judicial idealism of ＂ limitation of the efficiency of litigation＂. |
