How to handle the college student＇ s injury accidents properly and clarify the responsibility of university are hot issues to be discussed, which would be beneficial for safeguarding the legitimate rights of students, maintaining university teaching order, and ensuring the construction of harmonious campus. Neither the special power relation nor the private law contract relationship can account for the relation between university and students. Instead, the dual legal relationship is worthy of reference and study. Therefore, tort liability law should be applied to define the responsibility between the students and the university when the two parties have no definite contractual relationship.
