| Abstract: | Measures for Administration of Establishment of Partnership Enterprise by Foreign Enterprises or Individuals within China take effect on March 2010,and the reconstructing of internal and external investment enterprise law becomes the hot topic.The active law still exist some shortcomings,such as overlaps,insufficient,and inconsistent with principles of MFN treatment,so it is necessary to research its reconstructing.For Chinese partnership enterprise,the laws have achieved the combination between domestic and foreign;for company,the conditions are ripe enough.We can bring the Enterprises Organization Laws for the Law of Foreign Investment Enterprises of China into the three enterprises laws of China,make the matching detailed rules and method for the specialization of foreign investment,to realize the combination of enterprises laws between domestic and foreign. |
