| 摘 要： | 在我国，判例的法律地位存在着遵循先例原则和成文法优先适用原则，但这两个原则都不是绝对的。判例具有创立新规则和增强法律的灵活性等作用。我国判例制度的主要内容包括判例解释制度、判例公布制度、判例参照制度、判例统一制度。
