| 摘 要： | 我国法学界普遍认为现行《继承法》中规定的必留份制度已难以规范滥用遗嘱行为，皆推崇以国外成熟的特留份制度作为我国遗嘱继承的主要方式。但是，在评价特留份制度与我国《继承法》的衔接适用问题上，必须结合我国的国情、民情等实际情况，具体分析特留份制度在我国立法上的取舍，不能盲目遵从国际的流行趋势。

| Abstract: | Scholars of the jurisprudential circle generally believe that certain heirdom system stipulated by current Inheritance Law cannot standardize the abuse of will,and they all advocate mature legal portion system in foreign countries as the main pattern of will testamentary succession. However,we must combine our country＇s situation while evaluating the combination and application of certain heirdom system and our country＇s Inheritance Law,specifically analyze the legislation choice of legal portion system. We cannot abide by the international popular trend blindly. |
