| 摘 要： | 现代著作权法对著作权的保护,从限制或禁止侵权行为的防御性保护,发展到鼓励和促进著作权交易的积极性保护,源于知识经济与互联网时代"限禁"著作权侵权行为但难"止"的现实.现代著作权法励进著作权人最大限度地利用著作权实现权益.著作权保护期的限制、著作邻接权概念的创设、限制著作权的合理使用、法定许可与强制许可制度,及至著作权出资的投资形式,潜藏其中的是著作权人权益与公共利益之间的动态均衡.
