组织犯本体论

共犯人中的组织犯是最危险的共同犯罪人。由于大陆法系和英美法系均无组织犯这一概念 ,其只是存在于俄罗斯等现行刑法之中。我国刑法虽没有明确规定组织犯 ,但理论上是存在的。在当前形势下 ,为了更好地打击此类犯罪参与人 ,研究组织犯是非常必要的。本文拟从组织犯概念和其构成特征这两个角度进行探讨 ,以期对组织犯有一个更理性的本体认识 ,旨在推动我国对组织犯理论的研究向纵深发展。

The Study of the concept and Characteristics of the Organizing Criminal

The organizing criminal in accomplices is the most dangerous one.There is no concept of the organizing criminal in Civil Law or Common Law,it only appears in such present criminal laws as Russia's.Although the organizing crimina is not regulated in China's criminal law,it exists theoretically.Given current situations,it is rather necessary to make a research into the organizing criminal in order to crack down on crimes of this kind more effectively.This paper attempts to explore the organizing criminal from the angles of its definition and constructional characteristics,with the expectation of having a more reasonable understanding of it and forcing China's deeper research into the theory of the organizing criminal consequently.
